TERMS & CONDITIONS
Please read these Terms and Conditions (“Terms,” “Terms and Conditions”) carefully before using the https://www.kefiyoga.com/ website (the “Site”) operated by Kefi Yoga (KEFI) and or booking any events, classes, sessions or other activities at KEFI.
Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Site.
By accessing or using the Site you agree to be bound by these Terms. If you disagree with any part of the following, then you may not access the Site or participate in events, classes, sessions or other activities at KEFI.
WAIVER OF LIABILITY / RECOGNITION OF VOLUNTARY RISK
In consideration of and as an inducement to my participation and/or contribution of any fees and/or participation in movement, yoga, meditation, weigh lifting, other forms of exercise, or other activities at KEFI YOGA located at 23812 Crenshaw Blvd., Torrance, CA 90505 (hereinafter “KEFI”), I represent and agree as follows:
(1) I (hereinafter “I” or “applicant”) or my minor child has been examined by a licensed Physician within the past six months and have been found by such physician to be in good health and fully able to perform all exercises which I or my minor child is to learn and perform during my enrollment with KEFI.
(2) The use of the facilities at KEFI naturally involves the risk of illness or injury to me and/or my minor children, whether I or someone/ something else causes it. Further, the novel coronavirus / COVID 19 (hereinafter “Virus”) has been declared a worldwide pandemic by the World Health Organization. KEFI has put various preventative measures in place to reduce the spread of the Virus; however, it cannot completely eliminate the risk and cannot guarantee that you will not become infected while at the premise of the Place. Further, my presence at KEFI may increase the risk of contracting the Virus. As such, I understand and voluntarily accept this risk. I agree that KEFI, its owners, employees, officers, directors, shareholders, agents, and contractors will not be liable for any injury or damage, including, without limitation, personal, bodily or mental injury, economic loss, or any damage to me or my child resulting from the negligence of KEFI, its owners, employees, officers, directors, shareholders, agents, and contractors, or anyone using KEFI's facilities. I waive any claims arising from my use of KEFI's facilities whatsoever or from mere presence on the premises of KEFI.
(3) By executing this document, I voluntarily acknowledge the contagious nature of the Virus, the inability of KEFI to eliminate the potential spread of the Virus, and knowingly and voluntarily assume the risk for myself and my child that I or my child may be exposed to or infected by the Virus by attending classes, programs and activities offered at KEFI and that such exposure or infection may result in personal injury, illness, permanent disability, and death to myself or my child. I understand and acknowledge that the risk of becoming exposed to or infected by the Virus at KEFI may result from the actions, omissions, or negligence of myself and others including, without limitation, KEFI and its agents, volunteers, officers, directors, employees, or representatives, as well as other participants in any classes or activities at KEFI.
(4) I understand and agree that I will participate in movement, meditation and exercise only and that I hold harmless KEFI, its owners, its employees, officers, directors, shareholders, agents and contractors for any damage to or theft of personal property on or away from KEFI's premises, or personal injury, including but not limited to bodily injury, disease, disability, death, humiliation, or consequential loss of any kind arising out of my participation or my child's participation in KEFI's movement, meditation, and exercise. If at any time during the session, I feel discomfort or strain, I will gently come out of the posture. I understand that I may rest at any time during the class. I understand it is important that I listen to my body and respect its limits on any given day. I, the undersigned, understand that offerings at KEFI are not a substitute for Medical Attention, Examination, Diagnosis or Treatment. I should consult ‘My Doctor’ Prior to beginning any program, including the classes offered by KEFI for my overall wellbeing. I recognise that it is my responsibility to notify my ‘Instructor’ of any serious illness or injury before the Yoga Session. I will not perform any postures to the extent of strain or pain. I accept that neither KEFI, owners, employees, officers, directors, shareholders, agents, and contractors, or anyone using KEFI's facilities are liable for any injury, or damages, to person or property, resulting from participating in activities at KEFI.
(5) In the event that I am pregnant, I will not attend or participate in any activities at KEFI until I have discussed the potential risks to me or my unborn child / fetus with my obstetrician. I agree that I will follow my obstetrician’s recommendations and on behalf of myself, my heirs, spouse or other interested party hold harmless KEFI for any possible injury to myself or my unborn child / fetus.
(6) If I am under 18 years of age, I will disclose my age to the Place and provide my signature and the signature of my parent or legal custodian or guardian at KEFI prior to participating in any activities..
(7) Any donations or fees paid to KEFI or any of its owners or agents hereafter are non refundable, exceptions may be made if extenuating circumstances are deemed present by the management of KEFI.
(8) Any dispute arising out of or relating to this Hold Harmless Agreement, or the breach thereof, shall be finally resolved by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment upon the arbitration award may be entered in any court having jurisdiction.
(9) Any provision not in conformity with the law of any state or governing body having jurisdiction is hereby severed from this contract and the remaining provisions remain enforceable.
All participants in KEFI programs and activities agree to the WAIVER OF LIABILITY / RECOGNITION OF VOLUNTARY RISK.
CANCELLATION & NO SHOW POLICY FOR ALL CLASSES, SPECIAL CLASSES, EVENTS AND PRIVATE CLASSES
We recommend you arrive at least 10 minutes before class to settle in. The studio entrance will be locked promptly at class time for security purposes. Also, please be mindful of our in-studio late cancel policy (cancellation within 60 minutes of class start time will result in a $10 fee) and “no show” policy $15 fee including for members and/or pass holders) which can be invoked any time at the sole discretion of Kefi Yoga. A “no show” occurs when a student signs up for class and doesn’t show up and does not provide notice prior to the beginning time of the class. KEFI reserves the right to change class times or instructors. Please check our schedule for the most up-to-date class information. In the unfortunate event that KEFI has to cancel a class that a client signed up for, we will make efforts to accommodate each person on an individual basis. If a student is late to a class, gets locked out or late cancels, no credits for future classes or otherwise will be issued to students’ accounts.
A strict 72-hour cancellation policy is enforced regarding private classes, appointments, enrollments, special classes and events. If canceled prior to the 72 hour cancellation policy, customer will retain the credit on their account for the particular class, special event, workshop or private class. Payment for any of these special types of classes cancelled during the 72-hour window prior to the class will be considered completely forfeited (no credits for future classes or otherwise will be issued to students’ account - no exceptions). Please note that all private classes are to be scheduled through studio management. All private classes are not secured until payment is made in full.
NO REFUNDS WITHOUT EXTENUATING CIRCUMSTANCES EVALUATED BY MANAGEMENT ON A CASE-BY-CASE BASIS
Any donations or fees paid to KEFI for any product, class or other item or service or to any of its owners or agents hereafter are generally non refundable, exceptions may be made if extenuating circumstances are deemed present by the management of KEFI on a case-by-case basis.
FIRST THREE CLASSES ARE $55 OR TWO WEEKS UNLIMITED FOR $69!
Students that are new to Kefi receive their first three classes for $55 or two weeks of unlimited group classes for $69. Students must live locally to take advantage of these offers and it must be your first time booking a regular group class at Kefi Yoga. Specialty classes and Workshops that may be on the schedule are not included in this offer. This offer expires within two weeks of your first booking. If one of your intro classes is booked and you "late cancel" or "no show" that intro offer class is forfeited and your two week timer starts ticking for your other intro classes. This offer can be revoked at any time at the sole discretion of Kefi’s management team. This deal is for LOCALS that would be able to come to Kefi on a regular basis, not those that are just visiting or that are moving the next day far away. Thank you for not taking advantage of our small business.
BOOKING PRIOR TO ARRIVAL IS REQUIRED
Yes, online or phone reservations are required. The Momence app on your phone is accessible. Book through the classes tab on our website or access the Momence app if you already have an account. It is always recommended to show up 10 min early to check-in. Doors will open 15 minutes prior to class. Please cancel any reservations you have before 60 minutes from the start of class. Kefi reserves the right to impose late cancellations charges of $10. No shows can be charged $15/class.
WAITLIST FOR CLASSES
The class, event or workshop you want to book may fill up. If it does, you may add yourself to the waitlist on Momence. If, at a time before the "Momence cutoff period" (60 minutes before the start of the class) a spot in the class becomes available, the Momence system will automatically send a text to the first person on the waitlist, asking them to confirm that they want to be booked into the class. Text recipients will have 15 minutes to confirm that they want to be booked into the class before the Momence system moves to the next customer on the waitlist. Customers who don’t have a phone number on file will be contacted via email (Please note, if you are not "opted in" for email notifications in the Momence system, you will not receive an email notification). The empty spot in the class will be held as reserved until the system has gone through everyone on the waitlist (or until someone is booked in by management at their discretion). Waitlisted individuals can see their location on the waitlist via the Momence app. After the "Momence cutoff period" has passed (e.g., when there are 60 minutes or less remaining before the start of a class), the Momence system will stop texting/emailing waitlist members. Interested individuals can still arrive at the studio 15 minutes prior to the class/event, notify the instructor they are hoping to get into the event, and wait in the lobby for an available spot (not guaranteed). If customers that have booked into the class have NOT checked in at least 5 minutes prior to the class/event start time, their spot will then become available to on-site waiting individuals in a first come, first served basis.
ALL PASSES AND MEMBERSHIPS ARE NON-TRANSFERRABLE
All passes for any activities at KEFI, including special events, memberships, parties, classes, are non-transferrable.
EXPIRATION POLICY
Our drop ins and/or gift certificates/gift cards expire 1 YEAR from the date of purchase. Further, Class Packs expire within 3 to 6 months to a year from the date of purchase. We are unable to extend packages. No exceptions.
GIFT CERTIFICATES / GIFT CARDS
Kefi Gift Certificates can be redeemed in-studio or call to book. Gift Cards can be redeemed in-studio or online. Neither can be used for private enrollments or special events. They are restricted to Kefi’s “Group Class” schedule and in-store retail items.
CANCEL AND FREEZING MEMBERSHIPS
To cancel or freeze your membership, students are required to provide written notice with the reason for cancellation fill out our Membership Freezing & Cancellation Form by clicking this link https://form.jotform.com/21093063396115 or by emailing angel@kefiyoga.com
Please note: you must give notice of cancellation or freezing through this form 14 days prior to the date your membership is scheduled to charge/renew. Further, membership agreements cancelled before the allotted cycles are subject to early cancellation fees (see terms of your particular membership agreement).
STORAGE OF PERSONAL PROPERTY IN THE STUDIO AT KEFI YOGA OR IN THE PARKING LOT
We have cubbies for your personal belongings when you come to class and storage benches for your shoes. However, Kefi Yoga is not responsible for lost or stolen items in the studio or in your car in the parking lot. If you do abadon your items at Kefi Yoga, it is not the responsibility of the staff or management to find out who the item belongs to and get it returned to that student. Anything left at Kefi is considered lost and Kefi is NOT responsible to contact you or return it (yes even if it has your name and phone number). Take your items home.
CASH VERSUS CREDIT CARD PURCHASES
KEFI does take cash, however, KEFI has minimal change on hand and credit cards are encouraged for less contact. Further, please keep a credit card on file at KEFI for your convenience.
QUESTIONS FOR INSTRUCTORS / MODIFICATIONS / RECOGNITION THAT INSTRUCTORS ARE NOT RESPONSIBLE FOR ADDRESSING ALL CONCERNS
Yoga asana is a challenging practice that demands a lot from the body, especially in KEFI’s heated offerings (vinyasa and sculpt). KEFI’s instructors will offer some modifications, but are not able to continually adjust or modify a single individual during a group class. Further, before and after class, KEFI instructors do not have a lot of time for lengthy discussions about yoga postures as they may have desk work or responsibilities to clean and sanitize the studio.
POLICIES REGARDING TEMPERATURE AND HUMIDITY CONTROL DURING CLASSES AT KEFI YOGA
All classes indicated as “Heated” on the schedule will be heated between 90-102 degrees. All “Hot Fusion” classes are heated anywhere from 98-105 degrees. There are also unheated offerings including Slow Flow, Unheated Beginner Classes and Yin where we don’t have the heat on. Our instructors are experienced and intuitive. They have the final determination on how to adjust the heat and humidity in the room depending on the instructors’ sequence, the amount of students in the room, time of day, weather outside the building, how hard the students are working and a host of other factors. The instructors’ preferences within the range indicated above controls the environment of each particular session at KEFI YOGA. Students are encouraged to respectfully provide feedback to the instructors and/or management regarding their preferences, however, please note that excessive complaints and attachments to preferences regarding one element or another will be handled by management on a case-by-case basis to minimize discord in the studio space.
DISRUPTIONS DURING CLASSES, EVENTS, OR OTHER ACTIVITIES AT KEFI / HARASSMENT OR DISCRIMINATION OF ANY KIND DISALLOWED
Disruptions during class will not be tolerated. This includes perfume/cologne, cell phones, excessive flatulence or indigestion, blowing your nose continually or excessive coughing, openly talking during practice, interrupting class with questions or comments, excessive noise, continually coming in and out of the room during class, or any other type of disruption during any activity at KEFI. Harassment or discrimination of any kind is not welcome at KEFI yoga. If a student fails to adhere to these policies, the student will be asked to leave the premises immediately without refund.
BEHAVIOR POLICY: CREATING A POSITIVE AND INCLUSIVE ENVIRONMENT FOR STUDENTS
Policy Statement:
At Kefi Yoga, we are committed to providing a welcoming and inclusive space for all students. This policy is designed to ensure that every individual feels respected, supported, and valued, and to prevent conflicts over personal spaces within the studio.
1. Respectful Communication:
All students are expected to engage in respectful and positive communication at all times. This includes refraining from raising your voice in studio when triggered, gossiping, spreading rumors, or engaging in any form of negative talk about fellow students, instructors, or the studio itself. We encourage students to communicate openly and honestly, focusing on constructive feedback and solutions. We have a No Gossiping policy here at Kefi. If Gossiping of any kind occurs in the lobby, the staff may gently remind you regarding our policy. When others hear you talking about someone else (no matter how innocent the conversation), there is an immediate divisive effect in our community. It creates exclusivity and insecurity as individuals often believe you may be talking about them and become self-conscious about being here etc. Please be mindful of this policy and if you would like to chat with fellow Kefians about others in your life, do it outside the lobby and studio or just direct your energy to something perhaps more productive and positive.
2. Positive and Supportive Attitude:
We expect all students to maintain a positive and supportive attitude towards each other. This means treating classmates with kindness, empathy, and compassion. Engaging in supportive behavior such as offering help, encouragement, and recognition is highly encouraged. Creating a nurturing environment contributes to the overall success and well-being of our student community.
3. Personal Space and Equipment:
Respecting personal space and equipment is crucial in maintaining a harmonious environment within the studio. Students should adhere to the following guidelines:
a. Personal Mat Placement: Each student is encouraged to find a preferred spot for their mat or equipment within the studio. Other students should respect these choices and avoid using or moving them without permission.
b. Shared Studio Spaces: In shared studio spaces, such as common areas or equipment storage areas, students should be mindful of others and ensure that their belongings do not interfere with the space or accessibility for others.
c. Cleanliness and Organization: Students are responsible for keeping their personal spaces clean and organized. Mats and equipment should be stored appropriately after use, and any mess or clutter should be promptly taken care of.
4. Conflict Resolution:
Conflicts may arise from time to time, especially regarding personal spaces within the studio. In such cases, students are expected to approach conflicts with a problem-solving mindset and adhere to the following guidelines:
a. Direct Communication: Students should address conflicts directly and respectfully with the individuals involved. They should express their concerns and work towards finding a mutually agreeable solution.
b. Mediation: If a resolution cannot be reached through direct communication, students may seek mediation from management to help facilitate a fair and satisfactory outcome.
5. Disciplinary Actions:
Failure to comply with this policy may result in disciplinary actions, up to and including verbal warnings, temporary suspension from classes, or termination of studio privileges, depending on the severity and frequency of the violation. The purpose of disciplinary actions is to ensure a safe, inclusive, and supportive environment for all students.
By adhering to this Studio Etiquette Policy, all students contribute to creating a positive and inclusive environment within our studio. This policy sets the expectation for respectful communication, positive attitudes, and conflict resolution strategies. Together, we can foster a culture of respect, kindness, compassion, and empathy, enhancing the learning experience and well-being of all students.
ALL VISITORS, CUSTOMERS, STUDENTS AND MEMBERS HAVE A LEGAL DUTY TO EXERCISE DUE CARE
Anyone that comes into our studio at KEFI has a legal duty to exercise due care. People need to act with reasonable caution and vigilance when in our establishment. If a student damages our facility or equipment (i.e. breaks a window or a mirror doing a handstand or other activity, damages our plumbing, damages our sound system, etc), a “you break it, you buy it” policy applies. All visitors are required to treat our facility with due care and respect. If any student fails to respect the premises, they will be asked to leave immediately without refund and can be asked to not return to KEFI in the future.
